The ninth circuit court has maintained a prohibition on sending state troops in the Oregon city, following a latest legal decision.

Appeals Court Concurs to Rehear Case

The federal appeals court decided on this week that it would rehear the case concerning the executive power with an expanded group of 11 judges. The court also vacated a earlier ruling from a smaller judicial group that had supported the federal government.

Legal Saga Over Military Presence

This legal directive represents the most recent development in a long-running legal battle over whether the administration has the authority and justification to send national guard forces in Portland. Approximately 200 federalized guard members have been in uncertainty since the end of September when the deployment effort was started in due to ongoing demonstrations.

Differing Viewpoints

The administration has argued that government employees at the ICE facility in south Portland were under attack, while city and state officials maintain that local officers have control of the circumstances.

In defiance of descriptions of Portland as a conflict zone, locals have been sharing footage of lush hiking trails and a vibrant culinary culture, and planning activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The Tuesday ruling came after a US district judge in the city issued two legal injunctions this period – one preventing the federal control of the Oregon national guard, and another stopping the use of any national guard troops in the state, after attempts to circumvent the first order by calling up out-of-state forces.

On the previous day, the appeals court had temporarily suspended the initial decision – permitting command of 200 Oregon national guard – but the second ruling stayed effective, preventing the physical sending of the troops.

En Banc Review

The Tuesday decision means the matter will be heard “en banc” – with all decisions under consideration simultaneously – by a group of eleven justices.

“This ruling demonstrates that facts are important and that the judicial system are working to hold this administration accountable. The constitution restricts the executive authority, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment.

“The court is sending a definite signal: the president cannot send the armed forces into US cities without cause. We will continue defending Oregon’s laws, principles, and autonomy as this case moves forward and our fight continues in the courts.”
